1. About these terms

These Terms & Conditions apply to kvetosunspire.au (the “Website”), which is operated by KVETO GROUP PTY LTD (ACN 699 070 098, ABN 36 699 070 098), trading as KVETO SUNSPIRE (“Kveto Sunspire”, “we”, “us” or “our”).

By accessing or using the Website, you agree to these terms. If you do not agree, do not use the Website. You must be at least 18 years old to submit a quotation request or enter into a contract with us.

Our Privacy Policy explains how we handle personal information and forms part of the information relevant to your use of the Website.

2. Acceptable website use

You may use the Website for lawful personal or business purposes connected with learning about or enquiring into our solar, battery and related services.

You must not:

• use the Website unlawfully, fraudulently or in a way that infringes another person’s rights;
• attempt to gain unauthorised access to the Website, server, data or connected systems;
• introduce malicious code, scrape the Website excessively, interfere with security, or disrupt availability;

Solar generation, battery operation, bill savings, payback periods, rebates, feed-in tariffs, export capacity and backup performance depend on factors including location, roof orientation and condition, shading, weather, consumption, tariffs, equipment, system design, network requirements and user behaviour.

Any calculator, example, case study, indicative system size, price range, saving or performance figure is an estimate or illustration unless expressly included as a binding term in an accepted written contract. Actual outcomes may differ.

We try to keep the Website accurate and available but do not warrant that all content is complete, current, error-free or continuously available. Product specifications, incentives and regulatory requirements can change.

4. Enquiries, assessments and quotations

Submitting an enquiry does not require you to purchase and does not create a contract for products or services. It authorises us to contact you about the enquiry and use the information supplied in accordance with our Privacy Policy.

A preliminary discussion, proposal or quotation may rely on information supplied by you and information available before a site or technical assessment. It may be subject to verification, product availability, site conditions, electrical and structural requirements, network approval, applicable standards and a final agreed scope.

A contract for a project arises only when an offer is accepted in the manner stated in the relevant quotation or customer contract. If these Website terms conflict with an accepted project contract, the project contract prevails for that project to the extent of the inconsistency.

5. Products, installation and other services

Service availability depends on location, property type, access, site condition, system type, required qualifications, product availability and our capacity. Website descriptions do not guarantee that a service is available for every property.

Where a project proceeds, the accepted quotation or customer contract should identify the products, scope, exclusions, responsibilities, estimated timing and applicable project terms. Installation or electrical work may be performed by appropriately qualified and licensed personnel or contractors as specified for the project.

Product images are illustrative. Brands, models, specifications and warranties are subject to the accepted project documents and applicable manufacturer terms. We will not knowingly substitute material products without dealing with the change in accordance with the relevant contract and law.

Do not open, modify or attempt to repair solar, battery or electrical equipment unless you are authorised and appropriately qualified. For smoke, fire, sparking, exposed wiring or immediate danger, keep away and contact emergency services or the appropriate electricity authority.

6. Pricing, finance, rebates and incentives

Unless stated otherwise, Website prices are indicative only. The price and payment schedule for a project will be stated in the relevant quotation or customer contract and may depend on site assessment, design, equipment, access, metering, switchboard, network, compliance and other project requirements.

Rebates, certificates, incentives, feed-in tariffs and finance are subject to eligibility criteria, third-party approval, program availability and change. Website information does not guarantee eligibility, approval, value or continued availability.

Finance products, if offered, are provided under the finance provider’s terms and approval process. We do not provide financial advice. Consider obtaining independent advice before making a financial decision.

7. Your responsibilities

When using the Website or making an enquiry, you agree to:

• review all quotation, design, product, pricing and contract information before acceptance; and

Unless otherwise stated, the Website and its text, graphics, branding, layout, software and other content are owned by or licensed to Kveto Sunspire and are protected by intellectual property laws.

You may print or save reasonable extracts for evaluating our services. You must not reproduce, modify, distribute, frame, sell or commercially exploit Website content without written permission, except as permitted by law.

Third-party product names, logos and trademarks belong to their respective owners. Their appearance does not transfer any rights to you.

Continued use of the Website after an update constitutes acceptance of the revised terms, but changes do not retrospectively alter an existing project contract unless agreed or permitted by that contract and law.

If a provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary without affecting the remaining provisions. A failure to enforce a provision is not a waiver.

These Website terms are governed by the laws of Victoria, Australia and applicable Commonwealth laws. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
